O-1A Extraordinary Ability in Sciences, Education, Business or Athletics
O-1A requires extraordinary ability demonstrated by sustained national or international acclaim, evidenced by at least three of eight regulatory criteria. Unlike EB-1A it is employer- or agent-sponsored and requires an advisory opinion from a peer group. USCIS updated its O-1A policy guidance in 2023 to expressly address evidence typical of STEM and startup founders, which changed what a well-built O-1A packet looks like.
